Gasoline Distribution Bulk Terminals, Bulk Plants & Pipeline Facilities

Applicability

eCFR Subpart BBBBBB [ecfr.gov]

Subpart BBBBBB applies to bulk gasoline terminals, pipeline breakout stations, pipeline pumping stations, and bulk gasoline plants that are area sources* of hazardous air pollutants (HAPs). HAPs generally found in gasoline vapors include benzene, ethylbenzene, hexane, toluene, xylenes, isooctane, naphthalene, cumene, and methyl tert-butyl ether.

Not subject to this rule: Gas Dispensing Facilities, such as retail gas stations, that are subject to 40 CFR Part 63, Subpart CCCCCC; and bulk gasoline terminals and pipeline breakout stations that are subject to the control requirements of 40 CFR Part 63 Subpart R (Gasoline Distribution, Stage I).

As of May 17, 2009, Gasoline Distribution Facilities (bulk terminals/plants/pipelines) who are subject to Subpart BBBBBB, and have a maximum design capacity larger than 20,000 gallons per day may take operational limits if their actual daily throughput is always less than 20,000 gallons per day. Please consult the Notice of Intent information posted in the Resources section of this page.
*An area source of HAP has the potential to emit <10 tons per year (tpy) of a single HAP or <25 tpy of a combination of HAPs.

Important Dates

Source Classification

  • Existing Source = constructed or reconstructed on or before 11/9/06
  • New Source = constructed or reconstructed after 11/9/06

Initial Notification

  • None for underground storage tanks at bulk gasoline plant (<20,000 gallon/day throughput) if complying with NE State Fire Marshall law for submerged fill and only have underground tanks
  • Existing source = 5/9/08
  • New source = 5/9/08 or upon startup

Compliance Dates

  • Existing source = 1/10/11
  • New source = 1/10/08 or upon startup

Compliance Status Notification

  • None for underground storage tanks at bulk gasoline plant (<20,000 gallon/day throughput) if complying with NE State Fire Marshall law for submerged fill and only have underground tanks
  • Within 60 days of compliance date

Notification of Performance Test

  • 60 days prior to test

Compliance Reports
