Nebraska Hazardous Waste Regulations Outreach Meeting Scheduled

Dec. 22, 2015 ­— The Waste Management Division of the Nebraska Department of Environmental Quality (NDEQ) invites hazardous waste generators, managers and stakeholders to participate in a second outreach meeting concerning proposed amendments to Title 128-Nebraska Hazardous Waste Regulations.

The focus of this meeting will be to discuss proposed regulatory text, available on NDEQ's website at /resources-services/laws-regulations/environmental-quality-council/draft-and-proposed-rules-and-regulations. The changes appear as redline text in those chapters proposed for amendment.

The proposal consists of the following items:

  • For Chapters 1, 2, 3, 5, and Appendix V, we propose to adopt federal revisions to the Definition of Solid Waste (DSW). These revisions continue to encourage the recycling and reclamation of hazardous secondary materials while ensuring that these activities do not create human health or environmental risks.
  • For Chapters 12, 13, 14, and 15, we propose to adopt federal provisions related to public participation in the permitting of hazardous waste management units. The provisions, found in 40 C.F.R. Part 124, are needed to maintain state equivalency with the federal program and are no more stringent than federal requirements. The main differences from current state requirements are a pre-application public meeting and creation of an information repository for some permit applicants.
  • For Chapters 1 and 2, we propose to adopt federal revisions to the export provisions of a 2008 rule which streamlined the management requirements for recycling of used cathode ray tubes (CRTs) and glass removed from CRTs. Nebraska adopted the 2008 rule and must adopt the revisions to maintain state program equivalency.
  • For Chapters 10, 11, 20 and 25, we propose typographical corrections.

An open house meeting to discuss the proposal will be held on Wednesday, January 27th at 2:00pm CDT. The meeting will be held in Room 424 on the 4th floor of NDEQ Headquarters, 1200 N Street, Lincoln, Nebraska 68508.
