Applicability

eCFR Subpart E [ecfr.gov]

This subpart applies to:

  1. Incinerators that can charge more than 45 metric tons/day (50 tons/day) and commence construction or modification after Aug 17, 1971.


Not subject to this subpart:

  1. Any facility subject to NSPS Cb, Eb, AAAA, or BBBB.
  2. Any facility covered by an EPA approved State section 111(d)/129 plan implementing subpart Cb or BBBB of this part is not covered by this subpart.
  3. Any facility covered by subpart FFF or JJJ of part 62 of this title (Federal section 111(d)/129 plan implementing subpart Cb or BBBB of this part) is not covered by this subpart.
