Metal Fabrication - Area Source Categories

Applicability

eCFR Subpart XXXXXX [ecfr.gov]

Area Sources* of HAPs are subject to this subpart if they are primarily engaged in any of the following activities:

  1. Electrical and electronic equipment finishing operations
  2. Fabricated metal products manufacturing
  3. Fabricated plate work (boiler shops) manufacturing
  4. Fabricated structural metal manufacturing
  5. Heating equipment manufacturing, except electric
  6. Industrial machinery and equipment finishing operations
  7. Iron and steel forging
  8. Primary metal products manufacturing
  9. Valves and pipe fittings manufacturing

This subpart applies to the following operations at Area Sources* that contain or have the potential to emit metal fabrication or finishing metal HAP (MFHAP), which are materials that contain cadmium, chromium, lead, or nickel ≥ 0.1% by weight, or materials that contain manganese ≥ 1.0% by weight:

  1. Dry abrasive blasting
  2. Machining
  3. Dry grinding and dry polishing with machines
  4. Spray-applied painting
  5. Welding


Subject facilities are classified within the following NAICS or SIC codes:

This subpart does not apply to:

  1. Research or laboratory facilities
  2. Equipment repair operations, facility maintenance, or quality control activities
  3. Operations performed at on-site installations owned or operated by the Armed Forces, National Aeronautics & Space Administration, or the National Nuclear Security Administration;
  4. Operations that produce military munitions by or for the Armed Forces or equipment directly and exclusively used for transporting military munitions; and
  5. Operations that do not use or emit the listed MFHAPs


*Area Sources of HAPs emit or have the potential to emit:

  • < 10 tons per year of any single HAP, or
  • < 25 tons per year of combined HAPs.
  • Major Sources emit more than Area Sources.

Important Dates

Source Classification

  1. Existing Source
    • Commenced construction or reconstruction before April 3, 2008
  2. New Source
    • Commenced construction or reconstruction on or after April 3, 2008

Initial Notification

  1. Existing Source
    • Must notify by July 25, 2011
  2. New Source
    • Must notify by November 20, 2008 or within 120 days of startup, whichever is later.

Compliance Dates

  1. Existing Source
    • Must comply by July 25, 2011
  2. New Source
    • Must comply by July 23, 2008 or upon startup, whichever is later.

Compliance Status Notification

  1. Existing Source
    • Must notify by November 22, 2011
  2. New Source
    • Must notify by November 20, 2008 or 120 days after startup, whichever is later.

Annual Certification of Compliance Report

  1. First report must cover the period beginning on the compliance date through December 31
  2. Subsequent reports must cover January 1 - December 31
  3. Reports must be submitted by January 31
  4. If sources have an operating permit, they may send their annual report along with their certification of compliance report (due March 31)
