NOTICE OF INTENT TO RENEW PERMIT NE0204501
for City of Franklin construction and Demolition Landfill
under consideration by the
Nebraska Department of Water, Energy, and Environment
PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Water, Energy, and Environment (DWEE) has received an application to renew the permit of City of Franklin Construction and Demolition Waste Disposal Area, 619 15th Avenue Franklin NE. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five years.
FACILITY DESCRIPTION. The permit allows the operation of an existing Construction and Demolition disposal site under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.
FACILITY LOCATION. The property is located approximately 2 ½ miles south from Franklin, Nebraska. The legal description of City of Franklin construction and Demolition Disposal site is SW ¼ of the NE ¼ of Section 18, T1N, R14W of the 6th P.M. in Franklin County, Nebraska.
MAJOR MODIFICATION. This permit renewal includes a major modification to extend the life of the facility by constructing two more phases in the landfill.
OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. Public comments and hearing requests shall be made to: Daniel LeMaistre, Waste Permit Section Supervisor, Nebraska Department of Water, Energy, and Environment, P.O. Box 98922, Lincoln, NE 68509-8922.
The DWEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of City of Franklin Construction and Demolition Disposal Site, and public comment received. DWEE will notify the applicant and other interested persons.
COMMENT PERIOD. All comments or requests for a hearing must be postmarked by April 23, 2026.
