for City of Kimball Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Water, Energy, and Environment
PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Water, Energy, and Environment (DWEE) has received an application to renew the permit of City of Kimball Construction & Demolition Waste Disposal Area, 223 South Chestnut Street, Kimball, NE. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five years.
FACILITY DESCRIPTION. The permit allows the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.
FACILITY LOCATION. The property is located approximately one mile west of Kimball, Nebraska and is immediately south of and adjacent to State Highway 30. The legal description of the City of Kimball Construction & Demolition Waste Disposal Area is SW ¼ Section 25 Township 15 North Range 56 West of the 6th Principal Meridian Kimball County, Nebraska.
MAJOR MODIFICATION. This permit renewal includes a major modification to the Phase 2 bottom subgrade plan by excavating approximately 20 feet down and removing dirt in the berm between the Phase 1 and Phase 2 areas. Phase 3 was previously referred to as the disposal area located between the Phase 1 and Phase 2 side slopes. With the revision of the Phase 2 subgrade, filling will continue directly onto the existing Phase 1 side slope after removal of the existing cover soil, eliminating the need to designate a separate Phase 3. Therefore, Phase 2 and 3 will be combined and referred to as Phase 2 going forward.
OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The DWEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of the City of Kimball Construction & Demolition Waste Disposal Area, and public comment received. DWEE will notify the applicant and other interested persons.
COMMENT PERIOD. All comments or requests for a hearing must be postmarked by January 12th, 2026.
