Notice is given to the public, according to Chapter 10 of Title 129 - Nebraska Air Quality Regulations as amended September 28, 2022, that the Department is proposing to issue a Class II operating permit to Tuls Renewable Energy LLC – Butler County RNG Plant (FID# 120099) for a biogas treatment facility (Standard Industrial Classification code 4925) located at 2670 D Rd, Rising City, Butler County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 0.11 tpy of Particulate Matter (PM), 0.11 tpy of PM ≤ 10 microns (PM10), 0.11 tpy PM ≤ 2.5 microns (PM2.5), 86.98 tpy Sulfur Dioxide, 4.14 tpy Oxides of Nitrogen, 2.11 tpy Carbon Monoxide, 0.31 tpy Volatile Organic Compounds, 1.63 tpy of Hydrogen Sulfide, 0.08 tpy of hexane (largest quantity individual Hazardous Air Pollutant (HAP), 0.11 tpy total HAPs, and 9,249 tpy Greenhouse Gases CO2 equivalents (CO2e).
Butler County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Butler County meets the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.
The NWDEE proposes to issue a Class II operating permit with specific conditions, based on Title 129, which authorizes the use of a gas cleaning skid and enclosed flame, limits the maximum outlet concentration of hydrogen sulfide, and specifies operational, recordkeeping, and reporting requirements.
The proposed permit and supporting materials are available for inspection by the public Wednesday, September 24th, 2025 through Monday, October 27th, 2025 at the office of the NDWEE, 245 Fallbrook Boulevard, Lincoln, Nebraska, and electronically at https://dwee.nebraska.gov/. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
