PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to Adams Lot 1 RNG LLC (FID 121341) for a new anaerobic digestion and biogas processing facility (Standard Industrial Classification Code 4925 – Gas Production) located at 0.3 miles west of the intersection of 795 Drive and Road 438, Broken Bow, Nebraska, 68822, Custer County. The anticipated emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction will be: 11.16 tpy of Particulate Matter (PM); 11.14 tpy of PM ≤ 10 microns (PM10); 11.14 tpy PM ≤ 2.5 microns (PM2.5); 209.62 tpy Sulfur Dioxide; 56.01 tpy Oxides of Nitrogen; 203.83 tpy Carbon Monoxide; 10.20 tpy Volatile Organic Compounds; 0.26 tpy of Hexane; and 0.79 tpy total Hazardous Air Pollutants (HAP).

Custer County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species. 

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which prescribes limitations, recordkeeping, operational requirements, and controls for the proposed anaerobic digesters, prescribes biogas and hydrogen sulfide flow rates, and subjects the proposed genset to applicable federal regulation.

The proposed permit and supporting materials are available Friday, May 2nd, 2025, through Wednesday, June 4th, 2025 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, 68521 and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered.  During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing.  The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
