PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a construction permit to CIE Norfolk GNS, LLC (FID 84534) an existing ethanol fuel manufacturing facility (Standard Industrial Classification Code 2869 - Industrial Organic Chemicals) located at 3002 N Victory Road, Norfolk, Madison County, Nebraska 68701 for the construction of a new ultra-dry grade ethanol system and the addition of a new baghouse. The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed changes to this facility will be: 4.38 tpy of Volatile Organic Compounds; 6.77x10-4 tpy Acetaldehyde and 0.25 tpy total Hazardous Air Pollutants (HAP).

Madison County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species. 

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which includes revision of construction permit CP19-024 conditions III.(C) and III.(J) and revision of permit CP23-008 Conditions III.(A), III.(D), and III.(H). Changes include new emissions units associated with the ultra-dry grade ethanol system: storage tank, retentate vessel, non-condensable packaging components, rail loadout skid, truck loadout skid, as well as a non-project related addition of a new hammermill. Increases in potential-to-emit (PTE) are from equipment leaks associated with the proposed system. NSPS applicability has been updated to include Subparts Kc and VVb.

The proposed permit and supporting materials are available April 21st, 2025 through May 23rd, 2025 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, 68521 and electronically at http://dee.ne.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered.  During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing.  The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
