PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Title 129 - Nebraska Air Quality Regulations as amended September 28, 2022, that the Department is proposing to issue a Class II operating permit to Chappell Municipal Power Plant (FID#58355) for the operation of a municipal electric generation power plant (Standard Industrial Classification code 4911) located at 757 2nd Street, Chappell, Nebraska 69129. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 1.90 tpy of Particulate Matter (PM), 1.75 tpy of PM ≤ 10 microns (PM10), 1.70 tpy PM ≤ 2.5 microns (PM2.5), 0.0005 tpy Sulfur Dioxide, 98 tpy Oxides of Nitrogen, 1.04 tpy Carbon Monoxide, 2.76 tpy Volatile Organic Compounds, 0.048 tpy total HAPs, and 5,009.88 tpy Greenhouse Gases CO2 equivalents (CO2e).

Deuel County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Deuel County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no significant impact on these standards is expected from this project. No impact is anticipated on habitat for any rare or threatened species.

The DWEE proposes to issue a Class II operating permit with specific conditions, based on Title 129, which authorizes the use of diesel RICE to produce a maximum of 6,465,902 kWh annually, which is required to use non-selective catalytic reduction to control CO emissions, and comply with NESHAP (40 CFR 63) Subparts A and ZZZZ.

The proposed permit and supporting materials are available for inspection by the public Wednesday, April 9th, 2025 through Monday, May12th, 2025 at the office of the DWEE, 245 Fallbrook Boulevard, Suite 100, Lincoln, Nebraska, and electronically at http://dee.ne.gov. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
