PUBLIC NOTICE OF PUBLIC HEARING

On May 28, 2025, notice was given to the public of the Nebraska Department of Environment and Energy’s (NDEE) intent to issue a Construction Permit to Omaha Public Power District (OPPD) – Cass County Station (FID 70919), to modify an electric generating peaking facility (Standard Industrial Classification code 4911) located at 3520 Mill Road, Plattsmouth, Cass County, Nebraska. The public notice was provided in accordance with Chapter 10 of Nebraska Administrative Code Title 129 – Nebraska Air Quality Regulations (Title 129).
Prior to the comment period, a public hearing was requested.
Notice is now given pursuant to Title 129, Chapter 10, Section 005, and Title 115 – Rules of Practice and Procedure, that the NDEE will hold a public hearing on the proposed permit. The public hearing will be held on Tuesday, July 1, 2025, beginning at 6:00 P.M. at the Plattsmouth Public Library, 401 A Avenue, Plattsmouth, Nebraska. Preceding the hearing, NDEE representatives will hold an information session from 4:00 to 5:00 P.M. to answer questions from the public related to the proposed permit. Comments received during the informational meeting will not be part of the administrative record. The comment period is also hereby extended and written comments received by NDEE prior to 5:00 P.M. CT on Monday, June 30, 2025, will be considered in the final decision on the proposed permit.
All interested persons may attend and testify verbally or by written submission at the public hearing. Interested persons should provide notice in advance to attend or testify at the public hearing by contacting the Air Quality Construction Permits Section via email to NDEE.airquality@nebraska.gov, via mail to 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska 68521, or by telephone at (402) 471-2186, no later than 5:00 P.M. CT, June 30, 2025.
The proposed permit and supporting materials are available for inspection at the office of the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska, and electronically at http://dee.nebraska.gov.
All persons, including the applicant, who believe any condition of the draft permit is inappropriate or that the Director’s tentative decision to issue the air quality construction permit is inappropriate, must raise all reasonably ascertainable issues and submit all reasonably available argument supporting their position by the close of the public hearing.
