Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to MBA Broilers (FID 73411), a poultry farm that raises broilers, fryers, roasters, and other meat type chickens for the decommissioning of an old incinerator unit (EU-1) to commission a new incinerator unit (EU-8), for a significant permit revision (Standard Industrial Classification code 0251 located at 61968 NE-41, Tecumseh, Johnson county, Nebraska, 68450).
The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed modification at this facility will be: -2.18 tpy of Particulate Matter (PM); -0.74 tpy of PM ≤ 10 microns (PM10); -0.74 tpy PM ≤ 2.5 microns (PM2.5); 0.15 tpy Sulfur Dioxide; 0.14 tpy Oxides of Nitrogen; 1.31 tpy Carbon Monoxide; 1.17 * 10-4 tpy Lead; 0.99 tpy Volatile Organic Compounds; and 0.81 tpy total Hazardous Air Pollutants (HAP).
Johnson County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. No impact is anticipated on habitat for any rare or threatened species.
The Department proposes to issue a construction permit with specific conditions, based on Title 129, which is to revise the construction permit to remove the old incinerator unit and to include the new incinerator unit.
The proposed permit and supporting materials are available Wednesday, August 27th, 2025 through Monday, September 29th, 2025 at the NDEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska 68521, and electronically at https://dee.nebraska.gov. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
