NOTICE OF PERMIT MODIFICATION ISSUANCE

The Nebraska Department of Environment and Energy (NDEE) proposes to modify the National Pollutant Discharge Elimination System/Nebraska Pretreatment Program (NPDES/NPP) permit to the City of Fremont Department of Utilities, 400 East Military Avenue, Fremont, NE, for the Lon D. Wright Power Plant, 2701 East 1st Street, Fremont, NE (NPDES# NE0001252; SIC 4911). The publicly owned coal-fired steam electric generating facility discharges process and non-process wastewater from Outfalls 001, 002, 003, 005, 008, CT1, MC1, and LP1 to Rawhide Creek, Segment EL1-10400 in the Elkhorn River Basin. Process wastewater discharges through Outfall 009, during emergency or maintenance events, to the Fremont Wastewater Treatment Facility which discharges final effluent to the Elkhorn River, Segment EL1-10000 in the Elkhorn River Basin. Modifications include the addition of Outfall 009 with the Other Conditions and Requirements section updated to reflect pretreatment requirements. The modification will not change the expiration date of the permit and will continue to restrict pollutant discharges to comply with the requirements of Department regulations. The draft permit, fact sheet, and other public information are available for review and copying at NDEE’s Lincoln Office, 245 Fallbrook Boulevard, Suite 100, Lincoln, Nebraska 68521, between 8:00 a.m. and 5:00 p.m. (CT), weekdays, excluding holidays. Written comments, objections, and/or hearing requests concerning permit issuance may be submitted to NPDES and State Permits Section, Nebraska Department of Environment and Energy, 245 Fallbrook Boulevard, Suite 100, Lincoln, Nebraska 68521; before the comment period ending date of June 14, 2025. A determination to hold a hearing will be based upon factual environmental or regulatory consideration.
