Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to Fireball Group, LLC (FID 106518), an existing data processing center, (Standard Industrial Classification code 7374) located at 14865 Gold Coast Rd, Papillion, Sarpy County, Nebraska.
The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed permit revision at this facility will be: 4.62 tpy of Particulate Matter (PM); 3.80 tpy of PM ≤ 10 microns (PM10); 3.04 tpy PM ≤ 2.5 microns (PM2.5); 0.03 tpy Sulfur Dioxide; 81.47 tpy Oxides of Nitrogen; 19.03 tpy Carbon Monoxide; 7.38 tpy Volatile Organic Compounds; 0.02 tpy of Benzene; and 0.04 tpy total Hazardous Air Pollutants (HAP).
All Counties in Nebraska currently meet the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS. There are currently no Counties classified as being in non-attainment with the State Total Reduced Sulfur (TRS) standards. It is the source’s responsibility to ensure no take of threatened or endangered species result from the proposed permit revision at the data center.
The Department proposes to issue a construction permit with specific conditions, based on Title 129, which allows the addition of thirty-four (34) Type 1 and ten (10) Type 2 emergency generator engines, all of which will be U.S. EPA Tier 2 certified engines. The revision also allows the construction of sixteen (16) cooling towers, each containing two (2) cells. The permitting action includes revising the facility-wide diesel fuel limit for emergency generator engines from 873,040 gallons to 1,180,000 gallons annually, as well as the addition of renewable diesel as a permitted fuel type to be used as part of the diesel fuel limit. Renewable diesel is a fuel derived from fats and oils, as opposed to the petroleum feedstock of regular diesel, and can be used as a replacement for, or mixed with, petroleum diesel due to having the same basic chemical structure.
The proposed permit and supporting materials are available Thursday, December 11th, 2025, through Monday, January 12th, 2026 at the NDWEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska 68521 and electronically at https://dee.nebraska.gov. Comments received by the Department during this period will be considered prior to the final decision. Only comments received by the Department during this period on new and significantly revised conditions to the previous construction permit(s) will be considered. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing. The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
