PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Nebraska Administrative Code Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue an air construction permit to CLOP Omaha NE LLC (FID 122487), a proposed data center (Standard Industrial Classification code 7374, Computer Processing and Data Preparation and Processing Services) located at 11684 S 158th Street, Papillion, Sarpy County, Nebraska.

The anticipated change in emissions of regulated air contaminants in tons per year (tpy) due to the proposed construction of this facility will be: 0.84 tpy of Particulate Matter (PM); 0.84 tpy of PM ≤ 10 microns (PM10); 0.84 tpy PM ≤ 2.5 microns (PM2.5); 0.04 tpy Oxides of Sulfur; 39.66 tpy Oxides of Nitrogen; 5.56 tpy Carbon Monoxide; 2.04 tpy Volatile Organic Compounds; 1.79*10-2 tpy of Benzene; and 3.83*10-2 tpy total Hazardous Air Pollutants (HAP).

All Counties in Nebraska currently meet the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to NAAQS. It is the source’s responsibility to ensure no take of threatened or endangered species results from the proposed data center

The Department proposes to issue a construction permit with specific conditions, based on Title 129, which would permit the construction of a new five-megawatt data center. This construction would include the installation of seven (7) diesel-fired emergency generator engines and their associated diesel storage tanks. These generator engines would be used in the event of power loss or interruption at the facility to allow the facility to maintain its operations.

The proposed permit and supporting materials are available Monday, October 6, 2025, through Friday, November 7, 2025, at the NDWEE, 245 Fallbrook Blvd, Suite 100, Lincoln, Nebraska 68521, and electronically at http://dee.nebraska.gov. Comments received by the Department during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing.  The request must be in writing and state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
