PUBLIC NOTICE

Notice is given to the public, according to Chapter 10 of Title 129 - Nebraska Air Quality Regulations, that the Department is proposing to issue a Class II operating permit to City of Neligh (Facility # 61713) for the operation of a power generating facility (Standard Industrial Classification code 4911) located at E ¼ NE ¼ Section 20 Township 25N Range 6W, 150 feet southwest of Hwy 275 and East 2nd St., Neligh, Antelope County, Nebraska. The potential emissions of regulated air pollutants (in tons per year (tpy)) at this facility will be: 1.90  tpy of Particulate Matter (PM), 1.75 tpy of PM ≤ 10 microns (PM10), 1.70 tpy PM ≤ 2.5 microns (PM2.5), 0.25 tpy Sulfur Dioxide, 98.00 tpy Oxides of Nitrogen, 26.03 tpy Carbon Monoxide, 6.13 tpy Volatile Organic Compounds, 0.076 tpy of Methanol, 0.240 tpy total HAPs, and 52.62 tpy Greenhouse Gases CO2 equivalents (CO2e).
 

Antelope County meets the National Ambient Air Quality Standards (NAAQS) for those pollutants subject to a NAAQS and is expected to continue in that status. Antelope County is unclassifiable in regard to the state Total Reduced Sulfur (TRS) standards and no TRS emissions are expected from this project. No impact is anticipated on habitat for any rare or threatened species.
 

The NDEE proposes to issue a Class II operating permit with specific conditions, based on Title 129, which authorizes limits NOx emissions to 98.0 tpy; requires compliance with NSPS Subpart IIII for Engine EU4; requires compliance with NESHAP Subpart ZZZZ for Engines EU1, EU2, EU3, and EU4; and requires a non-resettable hour meter on each engine.
 

The proposed permit and supporting materials are available for inspection by the public Tuesday, December 3rd, 2024 through Friday, January 3rd, 2025 at the office of the NDEE, 245 Fallbrook Boulevard, STE 100, Lincoln, Nebraska, and electronically at https://dee.nebraska.gov. Comments received during this period will be considered prior to the final decision. During this period the applicant, or any interested person or group of persons, may request or petition the Director for a public hearing, the request must state the nature of the issues to be raised and all arguments and factual grounds supporting their position. If a public hearing is granted by the Director, the hearing will be advertised by public notice at least 30 days prior to the hearing.
