for the City of Imperial Construction & Demolition Waste Disposal Area
under consideration by the
Nebraska Department of Water, Energy, and Environment
PUBLIC NOTICE is given in accordance with Title 132 - Integrated Solid Waste Management Regulations, Chapter 2, §011, that the Nebraska Department of Water, Energy, and Environment (DWEE) has received an application to renew the permit of the City of Imperial Construction & Demolition Waste Disposal Area, which is located about ½ mile south of Imperial, Nebraska. After review of the permit application, a preliminary determination has been made to recommend renewal of the permit. The term of the permit shall be five years.
FACILITY DESCRIPTION. The permit allows the operation of an existing construction and demolition waste disposal area under Nebraska's solid waste management laws and regulations. The construction and demolition waste disposal area shall accept waste which results from land clearing, the demolition of buildings, roads, or other structures, including, but not limited to, fill materials, wood, land clearing debris other than yard waste, wall covering, drywall, plaster, non-asbestos insulation, roofing shingles and other roof coverings, plumbing fixtures, glass, plastic, carpeting, electrical wiring, pipe, and metals.
FACILITY LOCATION. The property is located approximately ½ mile south of Imperial, Nebraska between Avenues 331 and 333. The legal description of the City of Imperial Construction and Demolition Waste Disposal Area is NW ¼ Section 9 Township 6 North Range 38 West of the 6th Principal Meridian Chase County, Nebraska.
MAJOR MODIFICATION. This permit renewal includes a major modification to expand the disposal area footprint by 2.9 acres with the construction of Phase 2. Current and historical operations were confined to Phase 1, which has a 2.3-acre footprint. Phase 1, however, is expected to reach capacity sometime in 2026, at which time filling operations will shift to Phase 2. Phase 2 will be located adjacent to Phase 1.
OPPORTUNITY FOR PUBLIC COMMENT AND HEARING. The public may submit written comments and may also request a public hearing on the permitting decision. A request for a hearing must be made in writing and state the issues proposed for discussion and their relation to the proposed permit renewal. The DWEE will make a final decision to renew or deny the permit based on the permit application, the compliance status of City of Imperial Construction and Demolition Waste Disposal Area, and public comment received. DWEE will notify the applicant and other interested persons.
COMMENT PERIOD. All comments or requests for a hearing must be postmarked by Monday, February 23rd, 2026.
