Emission Guidelines and Compliance Times - Subpart C

Applicability

This subpart contains the New Source Performance Standards (NSPS) General Provisions, which apply to all sources subject to an NSPS unless specifically stated otherwise in their NSPS subpart.

EG are required for sources that emit pollutants that:

  • Are not elsewhere regulated in the CAA as criteria pollutants or HAPs; and,
  • Would be regulated if the existing source were a new source.


States are required to submit State Implementation Plans (SIPs) that include Emission Guideline requirements if they have sources subject to an EG and the State is the delegated authority. If the State does not have any sources subject to an EG subpart, it is not required in their SIP.

SIPs describe to EPA how a state will control sources subject to an EG. SIPs may follow the requirements in the NSPS subpart or may be state specific requirements; however, state requirements must be at least as stringent as federal requirements.
