Off-Site Waste Recovery Operations

Applicability

eCFR Subpart DD [ecfr.gov]

This subpart applies to:

  1. Major Sources of HAPs* that qualify as any of the following:
    1. Waste management operations that receive off-site material and are regulated as hazardous waste treatment, storage, and disposal facilities (TSDF) under 40 CFR Part 264 or Part 265;
    2. Waste management operations that treat off-site wastewater and are exempted from regulation as a hazardous waste TSDF under 40 CFR 264.1(g)(6) or 265.1(c)(10);
    3. Waste management operations that treat off-site wastewater, where wastewater treament is the predominant activity performed at the plant site, and the plant is subject to either section 402 or 307(b) of the Clean Water Act but is not owned by a state or municipality;
    4. Recovery operations that recycle or reprocess off-site hazardous waste, and that are exempt from regulation as hazardous waste TSDFs;
    5. Recovery operations that recycle or reprocess off-site used solvent, and that are not part of a chemical, petroleum, or other manufacturing process that is required to use air emission controls by another NESHAP;
    6. Recovery operations that re-refine or reprocess off-site used oil, and that is regulated under 40 CFR 279 Subpart F.


*Major Sources of HAPs emit or have the potential to emit:

  • ≥ 10 tons/year of any single HAP; or
  • ≥ 25 tons/year of total HAPs.
  • Area Sources emit less than Major Sources.


Partial Exemptions**:

  1. Sources where the total quantity of HAPs contained in off-site material received is less than 1 megagram per year.
